Terms of Service

1. Agreement to Terms

By accessing or using MailBeacon ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and MailBeacon LLC ("MailBeacon," "we," "us"), a Utah limited liability company.

2. Description of Service

MailBeacon is an AI-powered Gmail inbox management tool that connects to your Google account via OAuth to classify emails by urgency, detect deadlines, create Google Calendar reminders, and deliver daily SMS alerts. The Service requires a Google account and your authorization to access Gmail and Google Calendar data as described in our Privacy Policy.

3. Google API Compliance

MailBeacon's use of Google APIs is governed by the Google API Services User Data Policy available at https://developers.google.com/terms/api-services-user-data-policy and the Google APIs Terms of Service at https://developers.google.com/terms. By using MailBeacon, you acknowledge that:

  • MailBeacon accesses your Gmail and Google Calendar data only as described in our Privacy Policy
  • You can revoke MailBeacon's access to your Google account at any time at myaccount.google.com/connections
  • MailBeacon's use of Google user data is limited to providing and improving the Service

4. Your Account

You are responsible for:

  • Maintaining the security of your Google account and MailBeacon account
  • All activity that occurs through your MailBeacon account
  • Ensuring your account information is accurate and up to date
  • Notifying us immediately at support@mailbeacon.io if you suspect unauthorized account access

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to other users' accounts or any part of the Service
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use the Service to violate Google's Terms of Service or Google API policies
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service in any way that could damage, disable, or impair the Service
  • Resell, sublicense, or transfer your account to any third party

6. Subscriptions and Billing

Free Plan: MailBeacon offers a free tier with limited features at no charge.

Paid Plans: Pro ($14/month or $134.40/year) and Business ($24/month or $230.40/year) plans are available. Paid plans provide access to additional features as described on our pricing page.

Billing: Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as described in our Refund Policy below. We use Lemon Squeezy as our payment processor. By subscribing, you authorize Lemon Squeezy to charge your payment method on a recurring basis.

Cancellation: You may cancel your subscription at any time from Settings → Subscription. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for.

Price Changes: We reserve the right to change subscription prices with 30 days advance notice. Continued use of the Service after a price change constitutes acceptance of the new price.

7. Refund Policy

MailBeacon offers a 30-day money-back guarantee on all paid plans — monthly and annual. If you are not satisfied with your subscription for any reason, contact us at support@mailbeacon.io within 30 days of your initial charge or most recent renewal charge and we will issue a full refund to your original payment method. Refunds are processed within 5-10 business days. After the 30-day window, refunds are not guaranteed but may be considered on a case-by-case basis at our discretion.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by MailBeacon LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.

Your data remains yours. We claim no intellectual property rights over the email classifications, keywords, or other data you create or input into the Service.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We are not liable for any losses or damages arising from Service downtime.

10. Third-Party Services

MailBeacon integrates with third-party services including Google (Gmail and Calendar APIs), Twilio (SMS delivery), and others. Your use of these integrations is also governed by the respective third parties' terms of service and privacy policies. We are not responsible for the practices of third-party services.

11. Geographic Availability

MailBeacon is currently intended for use by residents of the United States only. By creating an account or purchasing a subscription, you confirm that you are a resident of the United States. Users outside the United States may access the free tier but do so at their own risk and acknowledge that the service may not comply with the laws of their jurisdiction, including GDPR.

12. Termination

By you: You may stop using the Service and delete your account at any time from Settings → Delete Account.

By us: We reserve the right to suspend or terminate your account and access to the Service at any time for:

  • Violation of these Terms
  • Conduct that we determine to be harmful to other users, the Service, or third parties
  • Extended periods of inactivity (12+ months on a free plan)
  • Non-payment of subscription fees

Upon termination, your right to use the Service immediately ceases. We will delete your stored data within 30 days of account termination as described in our Privacy Policy.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MailBeacon does not guarantee that email classifications are perfect or that every important email will be surfaced. The Service is a productivity aid — always review your inbox directly for time-sensitive matters.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILBEACON'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID TO MAILBEACON IN THE TWELVE MONTHS PRECEDING THE CLAIM.

IN NO EVENT WILL MAILBEACON BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Indemnification

You agree to defend, indemnify, and hold harmless MailBeacon LLC and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction in those courts.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice in the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MailBeacon LLC regarding your use of the Service and supersede any prior agreements.
